Brooks EV Seasonal Rental Policy & Liability Release

Applies to all Halloween, Thanksgiving, and December holiday golf cart rentals. By completing checkout on any Brooks EV rental product, you acknowledge that you have read, understood, and agree to this policy in full.

1. Assumption of Risk & Release of Liability

Renting and operating a golf cart involves inherent risks, including but not limited to collision, tipping, falls, property damage, personal injury, and death. By renting from Brooks EV, the renter — on behalf of themselves, all drivers, all passengers, and all guests — voluntarily assumes all risks associated with possession and use of the golf cart.

Brooks EV is NOT liable for any damages, injuries, losses, claims, or expenses of any kind arising while the golf cart is in the renter's possession — from delivery drop-off until Brooks EV pickup — regardless of cause. Payment for the rental constitutes a full release of liability and a covenant not to sue Brooks EV, its owners, employees, and agents.

2. Driver Requirements

  • Drivers must be 16 years of age or older and hold a valid driver's license or learner's permit.
  • The renter (account holder) must be 18+ with a valid payment method on file.
  • The renter is responsible for every person who drives or rides on the cart during the rental period.
  • No driving under the influence of alcohol, drugs, or any impairing substance. No reckless operation, racing, or off-road abuse.

3. Renter Responsibility for Damage & Loss

  • The renter is financially responsible for all damage to, loss of, or theft of the golf cart during the rental period, beyond normal wear and tear.
  • The renter authorizes Brooks EV to charge the payment method on file for repairs, recovery, cleaning beyond normal use, or replacement cost.
  • Late returns are charged at 1.5× the daily rate per day until the cart is recovered.

4. Indemnification

The renter agrees to indemnify, defend, and hold harmless Brooks EV from any third-party claims, damages, or legal expenses arising from the renter's (or their drivers'/passengers') use of the golf cart.

5. Delivery, Pickup & Seasonal Rules

  • All rental prices include a $50 round-trip delivery/pickup fee and a $25 service fee unless stated otherwise.
  • Halloween rentals: all drop-offs occur October 30. No drop-offs or pickups on Halloween day (October 31). Pickup occurs after Halloween based on rental length.
  • Carts are delivered clean, charged/fueled, and safety-checked. Report any pre-existing damage within 2 hours of delivery by text with photos to 352-777-9909.

6. Cancellation

  • 7+ days before delivery: full refund.
  • 3–6 days before delivery: 75% refund.
  • Within 48 hours of delivery: no refund.

7. Governing Law

This agreement is governed by the laws of the State of Florida. Venue for any dispute lies exclusively in Hernando County, Florida. If any provision is found unenforceable, the remaining provisions remain in full effect.

8. Acknowledgment

Completing checkout on any Brooks EV rental product constitutes your electronic acknowledgment and acceptance of this entire policy, with the same force as a physical signature. A signed paper copy of the full rental agreement may also be required at delivery.
